The terms on which you may use our website and our referral service.

1. Acceptance of these terms
These Terms of Use govern your access to and use of the website at abalosmigration.com.au (the “website”) and the referral service provided by Abalos Migration (“we”, “us”, “our”).
By using our website or asking us to refer you to a migration professional, you agree to these terms. If you do not agree, please do not use our website or our service.
2. What our service is
We operate a free referral service. We take details of your situation and introduce you to one or more independent MARA-registered migration agents or Australian legal practitioners whose experience we consider relevant to your enquiry.
Our service begins and ends with that introduction. We do not act for you in relation to any visa or migration matter.
3. We are not migration agents
Abalos Migration is not a registered migration agent and is not an Australian legal practitioner. We do not provide immigration assistance, migration advice or legal advice as those terms are used in the Migration Act 1958 (Cth), and nothing on our website or communicated by us should be understood as such advice.
Any information on our website is general in nature only. It does not take account of your individual circumstances, objectives or needs, and it may not be current. You should not act, or refrain from acting, on the basis of anything on our website. Advice about your eligibility, your visa options and your application must come from a registered migration agent or an Australian legal practitioner.
4. Independent professionals
The migration agents and lawyers we refer you to are independent third parties. They are not our employees, agents, partners or representatives, and we do not control, supervise or direct their work.
Any engagement you enter into with a professional is a separate contract between you and them. Their fees, their scope of work, their terms of engagement and the advice they give are matters between you and them.
We make referrals in good faith, but we do not warrant or guarantee the suitability, quality, timeliness or outcome of any professional's services. We encourage you to make your own enquiries before engaging anyone, including verifying a migration agent's registration on the Office of the MARA register at mara.gov.au, or a lawyer's admission with the relevant state or territory authority.
5. Fees and referral fees
Our referral service is provided to you free of charge. We do not charge you for making an introduction.
Where you engage a professional we have referred you to, we may receive a referral fee or commission from that professional. We disclose this so that you are aware we have a commercial interest in referrals proceeding. Any fees you pay for migration services are payable to the professional you engage, on the terms you agree with them, and are not paid to or refundable by us.
6. No guarantee of outcome
Migration outcomes are determined by the Department of Home Affairs and, where applicable, by review bodies and courts. No one — not us, and not any professional we refer you to — can guarantee that a visa will be granted, that an application will be processed within a particular time, or that a particular outcome will be achieved. Any indication of likely outcomes or timeframes is an opinion only.
7. Your obligations
When using our website and service, you agree that you will:
- give us information that is true, accurate and not misleading;
- not send us information about another person unless you are authorised to do so;
- not use our website or service for any unlawful purpose, or in a way that could damage, disable or impair it;
- not attempt to gain unauthorised access to our website or any related systems; and
- not use our website to send spam or harvest contact details.
We may decline to make a referral, or discontinue providing our service to you, at our discretion.
8. Privacy
Our handling of your personal information is described in our Privacy Policy, which forms part of these terms. Importantly, by asking us to refer you, you consent to us disclosing your enquiry and the personal information in it to the migration professionals we introduce you to.
9. Intellectual property
Unless otherwise indicated, all content on this website — including text, layout, graphics, logos and design — is owned by or licensed to Abalos Migration and is protected by copyright. You may view, download and print content from this website for your own personal, non-commercial use. You must not otherwise reproduce, republish, adapt or distribute it without our prior written permission.
10. Third-party links
Our website may contain links to third-party websites, including government websites and the websites of professionals in our network. We provide those links for convenience only. We do not control those websites, we are not responsible for their content, and a link does not imply our endorsement.
11. Website availability
We aim to keep our website available and accurate, but we do not guarantee that it will be available at all times, uninterrupted, error-free, or free from viruses or other harmful components. We may change, suspend or discontinue any part of our website or service at any time without notice.
12. Liability
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded or limited. If we are liable under a consumer guarantee that cannot be excluded, our liability is limited (where the law permits) to resupplying the relevant service or paying the cost of having it resupplied.
Subject to the paragraph above, and to the maximum extent permitted by law:
- we are not liable for any advice, act or omission of any migration agent, lawyer or other third party we refer you to;
- we are not liable for the outcome of any visa application, review or other migration matter;
- we are not liable for any loss or damage arising from your reliance on general information published on our website; and
- we are not liable for any indirect, incidental, special or consequential loss, or for any loss of profits, opportunity, data or goodwill, however arising.
13. Indemnity
You agree to indemnify us against any loss, damage, cost or expense we suffer arising from your breach of these terms, your misuse of our website or service, or your provision to us of information that is false, misleading or that you were not authorised to provide.
14. Changes to these terms
We may update these terms from time to time. The current version will always be available on this page, with the date it was last updated shown at the top. Your continued use of our website or service after a change takes effect means you accept the updated terms.
15. Governing law
These terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts of appeal from them.
